These terms apply to your use of thisisperiscope.com, run by Periscope Digital Group Pty Ltd (ABN 27 620 864 093) ("PeriscoPe", "we", "us"). By using our website, you agree to them. If you don't agree, please don't use the site.
These terms cover the website only. Any services we provide are governed by a separate written agreement with each client. If that agreement conflicts with these terms, the agreement applies.
Our Privacy Policy explains how we handle personal information.
2. Using our website
You may use our website for lawful purposes only. You must not:
- interfere with the site's security or operation, or try to gain unauthorised access to it or our systems
- send spam, malicious code or automated submissions through our forms
- scrape, copy or republish our content in bulk without our written permission
- use the site in a way that infringes anyone's rights or breaks any law
When you contact us through the Work with us form, the information you give must be accurate and yours to share. Sending an enquiry doesn't create a client relationship or oblige either of us to work together.
We may change, suspend or remove any part of the website at any time without notice.
3. Our content
Ownership. The content on this website, including text, design, graphics, video, animation and code, is owned by PeriscoPe or used under licence. You may view it and share links to it. You may not copy, adapt or use it commercially without our written permission.
Client and partner brands. Client and partner names, logos and trade marks belong to their owners. They appear here to show work we have done or relationships we have, and don't mean the owner endorses anything else on this site.
Case studies and results. Results in our case studies reflect specific campaigns, at specific times, for specific clients. They are not a promise of results for your business.
Information, not advice. Articles, Signals entries and other material on the site are general information. They don't take your circumstances into account, so please get advice before acting on them. We try to keep content accurate and current, but we don't guarantee it is complete or up to date.
4. Links and embedded content
Our website links to other sites, such as LinkedIn and Instagram, and includes videos hosted by Vimeo. We don't control those services and aren't responsible for their content, availability or privacy practices. Their own terms apply when you use them.
You may link to our website, as long as the link isn't misleading and doesn't suggest we endorse you without our agreement.
5. Liability
Your rights under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that can't lawfully be excluded.
The website is provided as is. Subject to those rights, we provide the website without warranties of any kind. We don't promise it will be uninterrupted, error-free or free of viruses.
Limits on our liability. To the extent the law allows, we are not liable for any loss or damage arising from your use of the website, or from relying on its content, including indirect or consequential loss, loss of profit or loss of data. Where our liability can't be excluded but can be limited, it is limited to supplying the relevant service again or paying the cost of having it supplied again.
6. Governing law, changes and contact
Governing law. These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
Severability. If any part of these terms is invalid or unenforceable, the rest still applies.
Changes. We may update these terms from time to time. The current version is always on this page, and continuing to use the website means you accept it.
